Insolvency Bankruptcy Code 2016 : Applicability, Objectives and Salient Features.
The Insolvency and Bankruptcy Code (IBC) was enacted to replace a fragmented and ineffective legal landscape that relied on century-old laws and multiple overlapping statutes, such as the Companies Act and various recovery acts. Before the IBC, the lack of a single unified law led to jurisdictional confusion among multiple forums like the BIFR, DRT, and High Courts, resulting in an average resolution time of 4.3 years—significantly higher than global standards. This systemic delay strained the Indian credit system and hindered the recovery of defaulted assets. The Code was introduced to consolidate and amend these laws into a single framework to ensure time-bound resolution, maximize asset value, and promote entrepreneurship. By establishing clear rules for ranking claims and distinguishing between viable businesses (which deserve reorganization) and unviable ones (which should be liquidated), the IBC aims to improve the Ease of Doing Business, foster mature credit markets, and provide a transparent, predictable process for all economic stakeholders.
